These Terms of Service govern your use of the website and services provided by Nixy Kids LLC, a company registered in the State of Delaware, USA ("Nixy", "we", "us", or "our"). By placing an order or using our website at nixy.kids, you agree to these terms.
Nixy creates personalized songs for children. Upon completing a purchase, we use the information you provide (your child's name, age, hobbies, and occasion) to produce a custom MP3 audio file delivered to your email address within 24 hours.
All payments are processed securely through Stripe. By completing a purchase, you authorize Nixy Kids LLC to charge the displayed amount to your payment method. Prices are listed in USD.
Your order is confirmed once payment is successfully processed. You will receive a confirmation email with your order details.
We deliver every song within 24 hours of receiving your order and child information. The song will be sent as an MP3 file to the email address you provided at checkout.
We want you to love your song. If you are not satisfied, simply reply to your delivery email and describe what you would like changed. We will revise the song free of charge until you are happy.
If you are still not satisfied after revisions, contact us at hello@nixy.kids within 7 days of delivery to request a refund. Refunds are issued at our discretion and evaluated case by case.
Upon delivery and full payment, you receive a personal, non-exclusive license to use the song for personal, non-commercial purposes (e.g., playing at a birthday party, sharing with family, posting on social media). You may not resell, redistribute, or claim authorship of the song.
Nixy Kids LLC retains the copyright to all songs created.
You agree to provide accurate information when placing your order. You are responsible for ensuring the email address provided is correct. Nixy is not liable for non-delivery caused by incorrect email addresses.
To the maximum extent permitted by law, Nixy Kids LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of our service. Our total liability shall not exceed the amount paid for the order in question.
We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our service after changes constitutes acceptance of the new terms.
